A Struggle To Power: The Incredible Dispute Resolution Case Of Justice Brett Kavanaugh
Whether you sit on the side of the Trump administration, or stand firmly against it, one thing is for certain - the President’s actions have been mired in controversy. The most recent of which, involved appointment of Supreme Court Justice Brett Kavanaugh, amidst claims of sexual misconduct. Kavanaugh’s accusers split the public down the middle, throwing the now appointed Justice Brett Kavanaugh into a lengthy and extremely well-publicised case of dispute resolution of the highest order.
Judiciary Authority
The Supreme Court is the highest judiciary authority in the United States. Supreme Court judges are first nominated by the President himself, and then appointed after approval from Congress.
Supreme Court judges are responsible for setting major legal compliances. They also offer the final word on dispute resolution for cases that remain unresolved in lower courts. A panel of 9 judges, one Chief Justice and eight Associate Justices make up the Supreme Court, and their tenure is for life.
Brett Kavanaugh
Coming from an impressive background, Brett Kavanaugh was nominated by President Trump to serve in the Supreme Court. Kavanaugh attended Yale University, followed by Yale Law. Following this, he clerked for two federal appellate judges, worked in the solicitor general’s office under the George H. W. Bush administration and finally clerked for Anthony Kennedy - a Supreme Court Justice, who he replaced with his recent appointment.
Justice Kavanaugh’s appointment was surrounded by controversy, as seen in the mixed opinions still prevalent amongst the American populace. He was accused by three women, leading to lengthy dispute resolution - which, some believe, ended with a boot to the throat of women’s rights.
Vs Christine Blasey Ford
A professor of psychology, Christine Blasey For is affiliated with Palo Alto and Stanford universities. Earlier this year, Professor Ford stepped up and recounted a harrowing personal account of sexual assault. The perpetrator was Brett Kavanaugh.
Both Ford and Kavanaugh were asked to testified in court, their emotional appeals creating heavily followed headlines for the most high profile dispute resolution case of the year.
Vs Debora Ramirez
Next to come out was Deborah Ramirez. Ramirez was a classmate of Brett Kavanaugh in Yale University. She accused him of indecent exposure during a college event. Kavanaugh, however, was undeterred and presented his background as a model citizen and student as his defence.
Vs Julie Swetnick
High school classmate, Julie Swetnick was the third and final woman to come forth. She painted a picture of Kavanaugh as a bully that sexually intimidated women in school. But, her accusations did not hold enough credibility. They were deemed as a deliberate character assassination.

- Julie Swetnick was not interviewed, her claims were determined to be irrelevant.
Final Outcomes
Two distinct trains of thought exist about this dispute resolution. Some believe the entire debate was orchestrated by democrats, who did not want to see a far-right republican ascend to the highest judiciary position in America. Others, believe the appointment of Brett Kavanaugh signals a thorough failure of the justice system, with campaigns like #MeToo being stubbed out by indifferent authorities.
