1. What is Form STK-3?
Form STK-3 is used in accordance with [ clause I of sub-rule (3) of rule 4 of the Companies (Removal of Names from the Register of Companies) Rules, 2016]. It is an Indemnity Bond (To be drawn on Stamp Paper of Appropriate Value) and needs to be given individually or collectively by every director while filing STK 2.
This is a mandatory attachment for filing form STK-2 with the ROC under section 248 (2). Statement of Accounts needs to be certified by Chartered Accountant, Indemnity Bond duly notarized by each Director of the company in Form STK-3
2. Why is it important?
It is important because Form STK-3 gives the assurance that this company is no longer in running a business as it removes the name from the register of the Companies, And it also assures that the actual loss would be reimbursed to the holder, as it pays off the difference amount.
