1. What is Form STK 1?
This form is related to the notice by the registrar for the removal of a name of a company as per section 248(1) of the Companies Act 2013, The Registrar under this section may send notice to the company or the directors of the company for removing the name of the company which has failed to operate any business within 1or 2 consecutive years from its incorporation and request the company to present documentation to the registrar within 30 days from the date of the notice. If the company does comply with the prescribed time limit the registrar may remove the name of the company from MCA.
2. Why is it Important?
It is important in cases where a company is not carrying any business for two preceding financial years and hasn't made any application within this period to ROC or the company can also declare themselves as a dormant company by filling form MSC-1.
