Introduction

India, the second most populated country in the world, holds the current population of 136.64 crores. According to an UN report in 2019 India will surpass China as the world’s most populous country by 2027.

The Government of India is constantly making up plans and strategizing measures to control population growth in India.

On the occasion of World population day of 2021, the Uttar Pradesh government published the ‘Uttar Pradesh population bill' to control population and to implement two child norm in the state. According to Census India , Uttar Pradesh is the most populated state in the country with a population of more than 166 million people. Hence, the state comes in with the introduction of the said Bill.

 The Bill

The Bill largely focuses at providing necessary measures to control and stabilise the population of the state by implementing and promoting two child norm per eligible couples in the states by means of incentives and disincentives. {The Article aims to disucuss - UP population bill, UP population control bill, population control bill UP, population bill, population regulation bill}

Application:

The Population Control Bill will be applicable to all the eligible couples in the state of Uttar Pradesh where the boy should be 21 years or above and the girl should not be less than 18 years of age. {The Article aims to disucuss - UP population bill, UP population control bill, population control bill UP, population bill, population regulation bill}

The Incentives:

The Government has mentioned about the incentives given to the people under Section 4 to Section 7 of the bill. The couples who adopt two child norm shall be given the following incentives-

  • Two additional increments during the entire service.

  • Subsidy towards purchase of plot or building house.

  • Rebate on charges of utilities.

  • Maternity leave for 12 month with full salary and allowances.

  • 3% increase in the Employer’s contribution fund under national pension.

  • Fee health care facility and insurance coverage to spouse.

  • Additional incentives to those who will adopt one child norm.

The Disincentives:

Besides including incentives in the bill the government has also introduced disincentives and revocation of incentives under Section 8 to Section 12 of the Bill. The couples who will act against the population control bill shall face following disincentives-

  • Revocation of incentives mentioned under section 4 to section 7 of the Bill

  • Debarring from benefit of Government sponsored welfare schemes

  • Limit of ration card Units upto Four

  • Bar on contesting election to Local Body

  • Bar on applying to government jobs

  • Bar on Promotion in government services

  • Bar on receiving any kind of government subsidy           

 Exceptions:

As it is rightly said “To every rule there is an exception,” the population control bill covers general exceptions under section 13 to section 16.

  • Multiple births out of a second pregnancy where it means more than one child in the same pregnancy.

  • Adoption of the third child under any law for the time being in force dealing with adoption in India.

  • Disability of the first or second child.

  • Death of the child provided the number of children should not be more than three, except in case of multiple births.

Duties of the Government:

There is a famous saying , ‘It takes two to make a quarrel’. A team cannot win a match unless all the players give their effort to make it happen. The duty of the people of the State is to adopt the policy and the duty of the Government is to develop an environment where the positive and expected outcome can be easily achieved. To achieve the determined outcome the government shall

  • Establish maternity centers at all the primary health centers

  • Distribute contraceptive pills, condoms, etc through Healthcare Centres and Non-Governmental Organizations

  • Encourage use of contraceptive pills, condoms, etc through Healthcare Centresand Non-Governmental Organizations

  • Spread awareness about family planning methods through community health workers such as auxiliary nurse midwife or accredited social health Activist

  • Ensure mandatory registration of pregnancy, deliveries, birth and death across State

Criticism :

With compliments comes criticism. The Population Control Bill has been criticized for its strict policies.

Many opposition leaders have criticized the policy of giving additional incentives to couples who adopt one-child policy under Section 5, Section 6(2), Section 7 of the Bill.

People have raised their dissatisfaction to the Section 9(1), 10(1), 11(1), 12 where the Bill says that people who will act against the Population control bill will be debarred from

  1. Contesting election to Local Body(section 9(1))

  2.  Applying to government jobs(section 10(1))

  3.  Promotion in government services(section 11(1))

  4. Receiving any kind of government subsidy(section12)

Conclusion:

The Government of Uttar Pradesh has aimed to reduce the Total Fertility Rate (TFR) from 2.8 to 2.1 in a decade. Uttar Pradesh, being the most populated state needs correct measures to control the population.
