Procedure of filing Refund complaint with Gurugram RERA
The Government of India enacted The Real Estate (Regulation and Development) Act in 2016. The Preamble to the Act reads, "An Act to establish the Real Estate Regulatory Authority for regulation and promotion of the real estate sector and to ensure sale of plot, apartment or building, as the case may be, or sale of real estate project, in and efficient and transparent manner and to protect the interest of consumers in the real estate sector and to establish an adjudicating mechanism for speedy dispute redressal and also to establish the Appellate Tribunal to hear appeals from the decisions, directions or orders of the Real Estate Regulatory Authority and the adjudicating officer and for matters connected therewith or incidental thereto." The Act has come into force from 1st May 2017.
The objective of the Act is to establish a regulatory framework for the real estate industry in order to promote its growth and development in a sustainable and orderly manner. This includes ensuring transparency in transactions between developers and homebuyers, ensuring that real estate projects are completed on time, and providing a mechanism for resolving disputes related to these projects efficiently.
The Real Estate Regulatory Authority (RERA) was created to regulate and protect the interests of consumers in the real estate industry. Any person can file a complaint with RERA on the following grounds:
Ø Delay in receiving possession of the property.
Ø False advertising by the developer.
Ø Discrepancy in the project's registration documents.
Ø Excessive advance payment required by the developer.
Ø Structural defects in the property.
Ø Incomplete or missing information about the project provided by the developer.
Process of Complaint Registration:
To file a complaint with the Haryana Real Estate Regulatory Authority (HRERA) in Gurugram, follow these steps:
1. Go to the HRERA Gurugram web portal (https://haryanarera.gov.in/login/loginview/2) and click on the "Complaint Registration" tab.
2. Complete the online complaint form and follow the prompts provided by the system.
3. Once the form is submitted, you will receive a complaint number for future reference.
4. Pay the required fee (Rs. 1000 per complaint plus Rs. 10 per annexure) by way of Demand Draft in favour of Haryana Real Estate Regulatory Authority Gurugram, payable at Gurugram or through the online payment gateway.
5. Take print out of the Registration Form (Performa-B) and make (One + number of respondents) copies.
6. Separately type out a detailed Complaint in the specified format as given in Regulation dated 16th February, 2018. Make (One + Number of respondents) copies and attach it with documents of step 5.
7. Include a copy of a certificate stating that you have sent a self-signed copy of the complaint to the respondent via both speed post and email. After delivering the complaint, you should attach tracking and email reports as proof of service. These documents should be annexed with the complaint.
8. Physically deliver (One + Number of respondents) copies of the set consisting of Complaint Registration Form and Annexure and Demand Draft of Fees Paid and Detailed Typed Complaint and Self-declared and signed certificate in the office of Authority by hand.
9. To stay updated on the status of your complaint, regularly check the HRERA website by entering your complaint details.
Note:
Ø You will need to submit a soft copy of the complaint in Word format, as well as a complete copy with annexures in PDF format.
Ø When filing a complaint, you must include the names and addresses of the respondents, as well as their email addresses and phone numbers, on legal paper.
Ø Physical copies of the complaint should be submitted to the HRERA office within 30 days of filing.
