1. What is Form NCLT 5 ?
Form NCLT 5 contains the format in which the Tribunal shall issue notice to the respondent to show cause against the application or petition on a date of hearing and accompanied by a copy of the application with supporting documents. If the respondent does not appear on the date specified in the notice the Tribunal, after reasonable opportunity to the respondent, shall forthwith proceed ex-parte to dispose of the application. This form is filed in pursuant to rule 37 of companies NClT rules 2016.
2. Why is it important?
Form NCLT 5 contains the format in which the NCLT bench will issue summons to the opposite party informing him about the case being filed against him and to file a reply of the same within a specified period of time.
