1. What is Form MGT 8?
Form MGT-8 is a certification provided by a Practicing company secretary on the annual return of the company. In Form MGT-8, the CS certifies that the annual return discloses the facts correctly and adequately and that it complies with the relevant provisions of the Company’s Act 2013. However, before providing this form to the company, the CS in question shall ensure that accounts of the company are true and free from any misrepresentations. This form is obtained by the following types of companies
A. Listed Company, or
B. A company having a paid-up share capital of Rs. 10 Crores or more, or C. A company with a turnover of Rs. 50 Crores or more
2. Why is it Important?
It is a statutory requirement of the company to get their accounts certified by an expert professional like the company secretary.
