Rental Agreements

Whether you rent out a single home as an extra source of income or manage properties and rents full-time. You're supposed to know everything as a landlord. The word "rent agreement" refers to a written agreement between a landlord and a tenant that specifies the length of the lease, the rental amount, the terms and conditions, and the landlord and tenant's respective duties. Both the landlord and the one taking in rent may save time and money by having a rent agreement in place. The agreement guarantees that the rent is paid on time and that the property is maintained by the tenant in the event of a landlord; in the case of a tenant, it ensures that the landlord does not modify the conditions of the rent at his or her discretion or ask you to depart the property.

A rental agreement is a contract of rental between the owner of a property and a renter who wants to have temporary possession of the property; it differs from a lease, which is normally for a certain period of time. The agreement must at a minimum identify the parties, the property, the rental period, and the rent amount for the term. The property owner is known as the lessor, while the tenant is known as the lessee.

The conditions of the renting are usually specified in an implied, explicit, or formal rental agreement or contract, which is governed and handled by contract law. Letting out real estate (real property) for housing tenure (where the tenant rents a dwelling to live in), parking space for a vehicle(s), storage space, full or sections of properties for business, agricultural, institutional, or government use, or other purposes are examples. 

The following terms should be included in any rental agreement:

  • The landlord and the renter must be identified.

  • The property's identification.

  • Payment terms and conditions for the renting.

  • The length of the tenancy, which is typically one month.

  • The tenancy's terms and conditions.

  • Liability rules for property damage and repairs.

  • Contract termination and renewal procedures are governed by these rules.

  • Rent and Security Deposit

  • Charges for maintenance, electricity, and water

  • Damages, Repairs, and Changes

  • Responsibilities of the Tenant

  • Responsibilities of the Owner

  • Termination and Extension of Leases

  • Clauses that aren't included anywhere else

A rental agreement is a legal arrangement between the landlord and the tenant. A well-structured rental agreement can help you avoid problems with your renter and defend you in court if problems develop. Your tenant will benefit from a thorough contract since they will have a better knowledge of the terms and circumstances of your rental.

Before we get started, there's one thing I'd want to point out. Although the phrases "rental agreement" and "lease agreement" are sometimes interchanged, a rental agreement is typically structured month to month, whereas a lease agreement is typically created to accommodate long-term leases of 12 months or more.

Rental agreement is drafted on stamp paper. In India, there are two forms of rental agreements: a 12-month lease and a 12-month rental agreement. The state government has enacted Rent Control Laws that control this. The other option is to enter into a lease and licencing arrangement for up to 11 months that is not subject to the Rent Control Laws. The rent agreement comprises fundamental information about the resident property, the owner's property, the renter's property, the duration of staying or renting the property, and the rent amount, among other things.

  • At the bottom of the document and at the end, make sure both parties (landowner and tenant) sign.

  • As an attachment, include a list of fixtures and a property schedule.
