Law against Drunken Driving in India
Drinking and driving is a serious issue in India. Every year, thousands of people are killed or injured due to drunk driving in India. In order to tackle this issue, the Government of India has implemented stringent laws to combat this menace. Drunk driving is a criminal offence in India and is punishable under the provisions of the Motor Vehicles Act, 1988. According to the law, it is illegal to drive a motor vehicle while under the influence of alcohol or drugs. If a person is found driving a vehicle while intoxicated, he/she can be charged with an offence and punished with imprisonment up to 6 months, a fine of Rs.2000 or both. The offender may also be disqualified from driving for a period of at least 6 months. The Motor Vehicles Act, 1988 also provides for harsher punishments for repeat offenders. If a person is convicted for the second time for drink driving, he/she can be imprisoned for up to 1 year and/or fined up to Rs.3000. The offenders are also liable to be disqualified from driving for a period of at least 1 year. To further strengthen the law, the Government of India has recently implemented the Motor Vehicles (Amendment) Act, 2019, which has introduced harsher penalties for drunk driving offences. Under this Act, if a person is found driving a motor vehicle while under the influence of alcohol or drugs, he/she can be imprisoned for up to 2 years and/or fined up to Rs.10000. In addition, the offender may be disqualified from driving for a period of up to 3 years. The Motor Vehicles (Amendment) Act, 2019 also provides for harsher punishments for repeat offenders. If a person is convicted for the second time for a drink driving offence, he/she can be imprisoned for up to 5 years and/or fined up to Rs.20000. The offender may also be disqualified from driving for a period of up to 5 years. In order to ensure strict implementation of the laws, the Government of India has also established various traffic enforcement authorities across the country. These authorities are responsible for monitoring and regulating traffic on Indian roads. They are also responsible for enforcing the laws relating to drink driving and other traffic offences. Apart from the laws and regulations, the Government of India has also taken various initiatives to educate the public about the dangers of drink driving. Various awareness campaigns have been run by the Government to educate people about the risks of driving while intoxicated. In addition, many public service messages have been released to spread awareness about drink driving and its consequences. Drink driving is a serious issue in India and it is important that we all take steps to ensure that we do not indulge in this dangerous activity. It is important that we all abide by the laws and regulations and take necessary precautions to prevent any accidents due to drink driving. We must also spread awareness about the perils of driving while intoxicated and take necessary steps to ensure that we do not put our lives and the lives of others at risk.
