In some jurisdictions, truth is an absolute defence to a claim of defamation. This means that if the statement made is true, then it cannot be considered defamatory. This is often referred to as atruth defence because it allows the accused to defend themselves by proving that the statement was factually true. The second defence available to those accused of defamation is public interest. This defence allows the accused to argue that the statement they made was in the public interest and therefore should not be considered defamatory. This defence is sometimes referred to as thefair comment defence because it allows the accused to argue that their statement was an opinion rather than a statement of fact. The third defence available to those accused of defamation is privilege. Privilege is a defence available to protect certain types of communications, such as those made in proceedings of public bodies or in certain types of reports. This defence allows the accused to argue that the statement was made in the context of a privileged communication and thus should not be considered defamatory. The fourth defence available to those accused of defamation is innocent dissemination. This defence is available to publishers or distributors of defamatory content, such as publishers of books or newspapers. This defence allows the accused to argue that they were not aware of the defamatory content and therefore should not be held liable for its publication.
