1. What is Form CHG-8 ?
CHG-8 is a Form for Application to central for requesting an extension. Charges created before the commencement of the Companies (Amendment) Ordinance 2019 will be granted an extension for a period of 300 days, and Charges created on or after the commencement of the Companies (Amendment) Ordinance 2019 will be granted an extension for a period of 60 days, subject to the payment of additional fees as prescribed.
Further, The Government has authority to extend the time period for particulars creation/modification/satisfaction of charge are not filed within the 300-day timeframe specified above. In Form No.CHG-8, along with the prescribed charge, an application for delay condonation u/s 87 must be filed with the Central Government.
2. Why is it important?
When a company creates or modifies charges, it must register them with the Registrar of Companies (ROC) within 300 days of the date of formation or change, but if they fail the company must then file a CHG-8 with the Central Government for a Delay Condonation, this will give extension to the Companies.
