1. What is Form CHG-6?
CHG-6 is a Form for notice of appointment or cessation of a receiver or a manager. Section 84(1), 384 of the Companies Act, 2013 and Rule 9(1) of the Companies (Registration of Charges) Rules, 2014 require the filing of Form CHG-6. It is completed within 30 days of the appointment or termination date. When an individual obtains a court order appointing a receiver or manager of a company's land, subject to a fee, or appoints such a person or receiver.
Subject to a charge or appoints such a person or receiver under the power of any instrument, the RoC must be notified in writing via eForm CHG-6 within 30 days of the order/appointment. The person appointed as receiver or manager must also inform the RoC in Form CHG-6 within 30 days of the termination of the appointment.
2. Why is it important?
CHG-6 form assures the person appointment and cessation of their service period, that is why it is mandatory to issue by the charged person. This form will authorise the concerned person and it will give authority to the person who has been appointed and who has ceased from the business.
