1. What is Form BEN-4?
Form BEN-4 is termed as a Notice to members seeking information. Pursuant to section 90(5) of the Companies Act, 2013 and rule 6. A company gives notice in Form BEN-4 to any person requiring him to furnish his beneficial interest. The company provides notice to any person whether he is or not a member of the company.
2. Why is Form BEN-4 used?
Form BEN-4 Notice to members seeking information. A company gives this notice to any person whether he is a member of the company or not. The company can at any time during the 3 years immediately preceding the date on which the notice is issued Company can give an application to the Tribunal when the person fails to give the company the information required by the notice within the given period of time or when the information given to the company is not satisfactory.
