Ban on Chinese Apps - Retaliate Through Economy Fight
India and China were preserving good relationships with each other in numerous ways economically, politically, culturally etc. Both are members of numerous international cooperation bodies like the United Nation system organizations, BRICS etc. Chinese troops confronted Galwan Valley at Ladakh and in this face off 20 Indian army personnel were assassinated. Moreover, numerous news bulletins came regarding compromise with confidentiality of data of the Indian users who were utilizing Chinese apps.

So, bearing in mind these fiery issues and the losses that Indian citizens suffered, government of India after thinking pros and cons and all the aspects legally, financially and economically and on September 2nd 2020, the government of India expelled 118 Chinese apps comprising PUBG beneath section 69a of IT Act, 2020 citing danger to privacy and national security of Indian citizens.
Earlier, on 29th June 2020, India expelled 59 Chinese Apps including the renowned TikTok app for the same reason. The government circulated a justification that these apps are illegally transferring data to locations outside India. It didn’t cite the relation of apps with China, but these apps are mostly of Chinese origin or have a chief part of investments from Chinese companies. The government gave a chance to these apps to embody their side and submit explanations.

As per the report of Indian Government, these apps were shifting the user data to the locations outside India in an unlawful manner. This was a serious threat to the privacy of Indian citizens. So, this ban on Chinese apps was a step towards protecting the privacy and security of Indian citizens’ data. The Ministry of Electronics and Information Technology in a press release proclaimed that it had received “many complaints from numerous sources, comprising several reports about misappropriation of some mobile apps obtainable on Android and iOS platforms for pilfering and stealthily transmitting users’ data in an illegal manner to servers which have locations outside India”.
As we look into the national laws of India, section 69A (1) of the IT Act authorises the Central Government or its officers to pass orders or directions for hindering access for the info provided to the public. But it cannot be done just like that. In order to do so, the central government must be gratified that, the said access to the information is categorised under any of the subsequent reasons, for the interest of the sovereignty and veracity of the nation, defence, safety of the Nation, for good relation with alien states, Public order, and for averting incitement to the commission of any offence which is cognizable. It is appropriate to note that the process for blocking is provided underneath the IT rules. Two ways have been provided by the act, one is the regular procedure and the other is the emergency process. In this specific case, the Indian Government had followed the emergency process. As per rule 9 of Information Technology Rules, the Designated Officer has to check whether the specific grievance comes under the domain of section 69A(1) of the IT Act and then make a reference to the secretary of the IT Department.

The Chinese economy got affected viciously by the interdiction of many Chinese apps and the import of goods by the Indian government. Just a few steps like elimination of Chinese software, saying no to Chinese products while purchasing goods from the market, purchasing Indian products, and becoming self-dependent on the P.M Modi scheme of “Atma Nirbhar Bharat “. We had no intent to boycott China even after the Covid-19 but the way it’s working is erroneous and we had to impart them a lesson. This is the correct time to become self-independent.
