1. The User means an individual, entity, or any legal person who authorizes Lawyered to assist and facilitate the clearance, resolution, or contestation of their challans on their behalf. By using the services, the User acknowledges that they:
- Provide Lawyered with the necessary consent and authorization to act on their behalf for challan-related processes.
- Understand that challan clearance, resolution, or contestation is subject to applicable laws and approval by relevant authorities.
- Are responsible for providing accurate information required for challan processing.
2. You acknowledge that by accepting these Terms & Conditions, You authorize Lawyered to check, resolve and pay challans on Your behalf before the respective Authorities, Tribunals, or Courts. The User agrees that Lawyered shall not be held liable for any legal or procedural outcomes arising from the challan resolution.
3. You acknowledge that by accepting these Terms & Conditions, You authorize Lawyered to check, verify and process payments for challan resolution through its platform on Your behalf including processing payments via third-party payment gateways.
4. You acknowledge that Lawyered shall not be liable for any errors or delays caused by third-party payment gateways or government systems.
5. You acknowledge that providing incorrect details including but not limited to challan details may result in delays, additional costs, or unsuccessful resolution. Lawyered shall not be liable for any penalties or consequences arising from incorrect or incomplete challan details submitted by the User.
6. You acknowledge that You will be given the option to select alternative legal professionals from other platforms should the need arise, and Lawyered does not require You to exclusively utilize Lawyered’s empanelled legal professional.
7. The User acknowledges that Lawyered’s challan resolution service includes legal representation and guidance but does not guarantee waiver or reduction of fines, as final decisions rest with the relevant Authority, Tribunal, or Court.
8. The User acknowledges that Lawyered may collect necessary documents required for challan resolution including but not limited to vehicle details, KYC documents and authorisation letter.
9. The User acknowledges that Your physical presence may be required if requested or directed by the Hon’ble court or law enforcement agencies or other competent authorities, or when Lawyered determines that the User’s presence is necessary to comply with due legal process. Lawyered shall inform the User in advance if their presence is required and shall not be liable for any consequences arising from failure to appear when mandated.
10. The User acknowledges that challan insights provided by Lawyered rely on data retrieved by the third party vendor and other external sources. Lawyered does not warrant the accuracy, completeness, or real-time availability of such data. While Lawyered shall take reasonable steps to maintain accurate data retrieval, it shall not be liable for delays, errors, or technical issues arising from third-party systems.
11. The User acknowledges that the timeline for resolving the challan shall range between 30 to 90 working days from the date of receipt of all requisite documentation by Lawyered. This timeline is indicative and subject to variation based on the nature of the challan, processing time by relevant authorities, legal complexities, and any unforeseen circumstances beyond Lawyered’s control. Lawyered shall not be liable for any delays caused due to procedural requirements, government processing times, or other external factors.
12. Lawyered shall provide the court receipt to the User, wherever applicable, as and when it is received from the relevant authority within a reasonable timeframe. The receipt shall serve as authentication of the challan resolution or transaction.
13. The User acknowledges that upon providing authorization to Lawyered for challan resolution, Lawyered shall have the mandate to undertake all necessary legal procedures required to facilitate the resolution at its sole discretion, in accordance with applicable laws and regulations.
14. The User acknowledges that upon granting authority to Lawyered for challan resolution, Lawyered reserves the right to update the User’s registered mobile number, if required, on your behalf.
15. The User acknowledges and understands that Lawyered is not liable for any specific relief or outcome to be obtained from Lok Adalat, as the resolution process is subject to the discretion of the authorities and operates on a token-based system.
16. Refund Policy: The User is eligible for a full refund of the challan penalty amount and service fee, wherever applicable, provided that a valid refund request is submitted before the challan resolution application is filed with the Tribunal, Court, or relevant Authority. No refunds will be granted after the submission of the application with the Tribunal, Court, or relevant Authority. Refund requests will be evaluated on a case-by-case basis.
17. Lawyered reserves the right to modify, amend, or withdraw the terms of the campaign refund policy at its sole discretion, subject to applicable laws.
